The latest Wetlands and Waters of the US and State regulatory changes. Wetlands and endangered species regulations are changing as a result of new government policies. The United States Army Corps of Engineers (USACOE) may wind up with less authority over Waters of the US, while the State Water Resources Control Board intends to broaden its authority. The scope of the United States Fish and Wildlife Services Section 7 Biological Opinions has been limited in the courts and new policies may force more Section 10 Habitat Conservation Plans, adding years to a project’s entitlement process. While permit processing may get more complicated, Mitigation Banking is making ultimate compliance much easier.
